Registration is the only way to get trademark rights in Colombia and Latin America. No register means no rights.

Procedure for obtaining protection

First of all, applicants must decide which kind of trademark they would like to register, e.g.; word trademark, figurative trademark, etc.

Secondly, we highly recommend performing a search to evaluate the chances of obtaining the register. This is also an opportunity to discover any obstacles that the application may face.

Lastly, the trademark application must be filed before the Trademark Office.

Trademark Office checks the formal requirements and orders the publication in the Official Gazette. Oppositions may be filed.

If the application is granted, the trademark register will be in force for ten years.
