Key Aspects of Trademark Registration in Colombia and the Andean Community (CAN: Bolivia, Ecuador, Peru, and Colombia):
1. Registration is mandatory to obtain trademark rights in Colombia and Latin American countries. As a general rule: no registration means no rights.
2. Limited rights may exist for other types of signs, such as trade names, if they have been used in commerce. However, these rights are significantly weaker than registered trademark rights.
3. The Colombian Trademark Office (Superintendencia de Industria y Comercio – SIC) does not require original or physical documents. No formalities, notarization, or apostilles are needed for filings.
4. If granted, the trademark registration is in force for 10 years from the approval date.
5. Under CAN legislation, no proof of use is required for registration.
