Registration is the only way to get trademark rights in Colombia and Latin America. No register means no rights.
We represent to small, medium and large Colombian enterprises to protect their Intellectual Property as well as we represent foreign companies and law firms to register and protect their rights in Colombia and Latin America.
Despite there are common industrial property rules in Andean Community (Bolivia, Colombia, Ecuador, Peru), registers in those countries are independent to each other.
Procedure for obtaining protection
First of all, applicants must decide which kind of trademark they would like to register, e.g.; word trademark, figurative trademark, etc.
Secondly, we highly recommend performing a search to evaluate the chances of obtaining the register. This is also an opportunity to discover any obstacles that the application may face.
Lastly, the trademark application must be filed before the Trademark Office.
Trademark Office checks the formal requirements and orders the publication in the Official Gazette. Oppositions may be filed.
If the application is granted, the trademark register will be in force for ten years.
